Terms of Service

1. Acceptance of terms

By creating an account or uploading content to DATA HEDGE (the "Service"), you agree to be bound by these Terms. If you disagree with any part, do not use the Service.

2. The Service

DATA HEDGE lets you voluntarily contribute AI conversation history to a privacy-cleaned, structured dataset that can be used for AI evaluation, model improvement, and aggregated insights — based entirely on the consent scopes you have enabled. You earn ecosystem reward points (the "Points") for verified contributions.

The Service is offered as a private beta during the current phase. Functionality, pricing, and availability may change with 30 days notice.

3. Your account

• You must be at least 14 years old (or the legal age of consent in your jurisdiction) to use the Service.
• You are responsible for the security of your account credentials and for any activity originating from your account.
• One account per natural person. Sharing accounts is not permitted.
• You agree to provide accurate information during signup. We may suspend accounts that we reasonably believe were created fraudulently.

4. What you can upload

You may only upload content you have the legal right to share. This includes your own AI conversation logs from services like ChatGPT, Claude, Grok, Gemini, and similar platforms.

You may NOT upload:

• Other people's private conversations or correspondence.
• Material that infringes copyright, trademark, or other intellectual property rights.
• Content that violates the terms of service of the AI provider you obtained it from.
• Sexual content involving minors, hateful content, harassment, or content that incites violence.
• Government IDs, financial credentials, or medical records. These will be scrubbed by our cleaner, but uploading them deliberately is prohibited.
• Malware, exploits, or automated scraping of the Service.

5. License grant

You retain ownership of the content you upload. By uploading, you grant DATA HEDGE a worldwide, non-exclusive, royalty-free license to: (a) process the content through privacy cleaning, (b) store the cleaned dataset, (c) use the cleaned dataset consistent with the consent scopes you enabled in Settings.

This license terminates when you delete the dataset, except for cleaned, anonymised, aggregated insights that may already have been incorporated into model evaluation reports prior to deletion.

6. Points and rewards

• Points are ecosystem reward points tracked inside DATA HEDGE. They are not securities, tokens, currency, or guaranteed financial assets and may not be sold, transferred, or exchanged outside the Service.
• Points are awarded by admin review of the cleaned dataset. Quality, novelty, and category multipliers apply.
• We may adjust the points formula, multipliers, and tier thresholds with 14 days notice.
• Future utility of the Points may include access to premium features, leaderboards, or — if and when a token program launches — eligibility for distribution. No such program is committed.

7. Acceptable use

You agree not to:

• Reverse engineer, decompile, or disassemble the Service.
• Submit duplicate or low-quality uploads in an attempt to farm Points.
• Use the Service to harass other users or the team.
• Bypass rate limits, file-size caps, or admin review.
• Use automated tools to create accounts or submit uploads without explicit written permission.

We may suspend or terminate accounts that violate these rules.

8. Termination

You may delete your account at any time via Settings → Request full deletion. We complete deletions within 30 days.

We may terminate accounts for material breach of these Terms, for prolonged inactivity (12 months), or if continuing to operate the account becomes commercially infeasible. We will email you at least 14 days before terminating an active account for non-breach reasons.

9. Disclaimer

The Service is provided "as is" without warranty of any kind. We do not guarantee uptime, completeness of the privacy-cleaning pass, or that any specific dataset will be accepted by an admin.

Privacy cleaning is a best-effort first defence; you remain responsible for not deliberately uploading sensitive material.

10. Limitation of liability

To the maximum extent permitted by law, DATA HEDGE and its operators are not liable for indirect, incidental, special, or consequential damages arising from use of the Service. Total cumulative liability is limited to the greater of (a) the amount you paid us in the prior 12 months and (b) USD $50.

11. Changes

We may update these Terms. Material changes will be communicated via email and a banner on the dashboard at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
